Post-Nuptial Agreement

If my husband and sign a document that we have created ourselves and titled it as a “Post-Nuptial Agreement” and the months (or years) down the road we decide to separate, can that document be used only as a reference to draft a NEW Separation Agreement document (which may or may not contain the same terms), or is that Post-Nuptial Agreement automatically considered as a Separation Agreement? Thank you.

A post nuptial agreement just outlines how property, and other issues, will be handled in the event the two of you separate. Depending on the terms it may eliminate the need to negotiate property division, alimony, etc. if your marriage ends in a separation.
