The quarterly payments were put in our joint checking account and spent along with the other money that was there. That makes me think it would be considered marital.

The land would not be considered marital. The only reason the payments are considered marital is because they are income earned during the marriage and because they were deposited into a joint account and used.

My wife’s first husband inherited property that was shared with his other siblings. They rented the property and received quarterly payments. Her husband died. Later we married, and we received quarterly payments which we deposited in our joint account. We were married for 4 years. Is that property considered her separate property?
