My husband and I are separating but we currently still live together until I can move into the townhouse I agreed to buy. We are planning on paying cash for the townhouse out of our joint funds. My husband wants the townhouse in both our names until we are divorced, but I don’t think this is necessary since the townhouse will be considered joint property until then anyway. I’d like to put it in just my name to save any fee that would be incurred by taking his name off later. There is no risk to him if I put it solely in my name is there? Thank!
In order to truly purchase separate property before you are divorced the two of you must sign and file a free trader agreement. Regardless of the name on the deed you will have to settle up the value of the property when it comes to equitable distribution.
