Rule 15(a)

Hi, I received Rule15(a) or amended complaint from my husband’s atty. since the citation is incomplete, can I assume it to be 15(a) 1 or “Matter of Course”?

Am I given 21 days to reply?

My original Answers to his comp, ain’t was not verified because I was served by a Sheriff. Does this mean, my amended answers do not need verification too?

Thanks in advance.

Rule 15 of the North Carolina Rules of Civil Procedure is about amended pleadings.

A Plaintiff can amended his/her complaint at any time before a responsive pleading is filed. If you have not filed an answer to the original complaint, then the amended complaint is acceptable.

You must be properly served with the amended complaint. Service by sheriff’s deputy is proper service.

All complaints and counterclaims must be verified, meaning the party must sign a verification and have their signature notarized.

Your answer to the amended complaint and any counterclaims must be verified.
