Separation and Money

My wife and I have been living apart for 3 months. We do not have a separation agreement in place yet. Since there isn’t an agreement in place, is the money that we have earned in the past 3 months still considered marital property?

Nope. Once you’re separated, the money/assets that you had as of the day of separation is marital. Any money earned after that point is sole and separate.

I have been separated from my stbx for over a year, and we still have no separation agreement in place…it’s all being decided by the courts at this point…but what I’ve earned since leaving is just mine, and what he’s done with is money after that point is not my concern either.

The money you have earned since the date of separation is your separate property.
