Seperation aggreement

Me and my wife seperated to day I asked her for a seperation agreement weather drafted by attorney or our selfs she would not comment. Other than I dont know. We have agreed to keep it civil and out of court. I can only hope it happens that way. My qestion is. Is a aggrement that important and is there anything that I need to do in the next few days pertaining to our seperation?

You should absolutely have a separation agreement drafted to deal with the distribution of martial property. It is not necessary that it be done prior to your physical separation, however if you do not have your property rights settled prior to filing for divorce (after the year and a day of separation passes) you will need to file a claim for equitable distribution of property, or you lose your rights to have the court distribute the same and all property jointly owed will pass to the title holder.
