Small business

I have a small childcare my only source on income. I operate is alone all monies to operate come from me not the spouse. During seperation or divorce does he have any rights to any of the business only due to me starting it after we were married. With this business will that put me in any jeopardy of having to pay him any money or alimony.

If this business was started during the marriage, it is a marital asset which is subject to equitable distribution. Alimony is payable if it is determined that one party is the supporting spouse and the other is a dependent spouse. Once that determination is made, the court looks at whether you have an ability to pay, and if so, how much you can pay.
