Can you tell me if there is a statute of limitations on equitable distribution in NC?
The only thing I know is that there is no claim to ED if you are divorced.
So long are you are not yet divorced your claim is not barred.
Question on this. If you and your spouse are trying to work it out without filing anything and meanwhile your divorce is final, does that mean you can get out of having to share your 401K?
If your divorce is final you have lost the right to have the courts determine equitable distribution, and therefore unless both parties agree, the 401(k) cannot be divided.
