Separated from husband on 11/17/10. We have joint legal custody but the children live with me with the normal “every other weekend” visitation.

Since we didn’t separate until towards the end of the year in 2010, I understand that we can file taxes as “married filing separately” but who has the right to claim the children on their taxes?

You do since that have lived with your the majority of the year.

Well … I guess that’s where it gets “hairy”. They lived with us BOTH in the same home up until November and then they moved out with me on November 17. So that month and a half means they lived with me most of the year?
