I have received an inheritance during the course of my marriage. The money has been in an investment account under my name only since I received it, however I have withdrawn funds to pay off common debt and I was reading online that depending on the state the withdrawal can make the entire account common property or assets. I was hoping for some clarity on this subject before I tell my husband that I wanted a divorce.
The money remaining in your separate account is still your separate property and is not subject to division. The funds you used to pay martial debt will likely be considered a gift to the marriage and are not recoverable.
