When can children opine?

Is there any sort of law or guideline about the minimum living conditions that a child must be provided. My 16YO teenage daughter is being forced to sleep in the same bed with her 14YO teenage son brother while with my ex - and they are miserable and this is not what they are used to nor what they should be subjected to.

At what age do children in NC get a say in where they want to live? This is an unteneble situation for them both.

Your children can testify in court as to where they want to live. There are no set rules about living conditions, but sharing beds at that age does not seem appropriate to me. If you have a court order, I would move to modify. If you have an agreement, you should file an action for custody and have a judge determine what is appropriate.
