My question is this. My husband has visitation with his 10 year daughter every other weekend. The consent order says Friday after school until Sunday at 6p.m… She is 10 years old and because her mother turned off her house phone she got the child a cell phone. We feel it is inappropriate for a 10 year old to have a cell phone. My question is 2 fold. 1) She says my husband cannot pick up the child until after he gets out of work on Friday which is at 6pm because she doesn’t want her spending anymore time with me than necessary. Can we enforce the after school rule even if it is me picking her up from school? If so, what do we have to do to do this.
2) We have asked her since we have a house phone and each have a cell phones for the child to leave her cell phone at home. She can call her anytime on our phones that she wants. Because of this she says my husband cannot call the child on her cell phone ever again and that she needs to call the child on her cell phone or not at all. Are we within our right to ask that the child not have the cell phone in our home?
