1st right of refusal

Does this still come into play if my boyfriend and I ever get married? I took my his daughter to work with me (she is out of school) and his ex says that she should get her that he should have called her. The agreement says “except for full school days,if either party is not able to provide care for the minor child for a period of 4 hours or more during his or her custodial period they shall offer the other party the 1st right of refusal. If the other party is unable to provide care for the minor child the custodial parent shall be responsible for finding and paying for (if required) suitable child care.”

I work in a daycare facility so maybe we don’t interpret the agreement the same as her and her lawyer.

Sounds like if the child is not in school you have to call the ex wife first.
