You would mail a copy to the opposing party or the opposing counsel and clock it in at the Wake County Clerk’s office. The Clerk’s office is located on the 11th floor.

Wake County: In every thing I have read, the Rules of Civil Procedure for Wake County states that a Defendant (in this case myself as my spouse is filing the divorce papers) has 30 days to respond/answer the complaint once served or they can request a 30 day extension to file an answer. Everything I read is from the plantiff’s perspective, however, as the defendant, how do I go about requesting a 30 day extension to file my answer to the complaint? Is there a form I file with the Clerk of Court or is there another method to request the extension?
