Abandonment

My husband and I are working through the terms of our Seperation Agreement. His lawyer has drawn up the papers. My lawyer said I shouldn’t leave the marital property until the Agreement is in place because it would be viewed as abandonment. This could take a while and I can no longer stay in the house. It’s taking it’s toll on both of us. Why can’t I leave?

You may leave, and you will not be charged with abandonment. I do suggest you attempt to remain in the home until an agreement is in place if you have children.
