Abanndonment

If one spouse (no SA or other divorce proceedings signed yet) leaves the marital home, with or without children, but still pays their fair share of household expenses after leaving, is that considered abandonment or not? Is it possible that one spouse can leave the home, and not continue paying their fair share of expenses (particularly if leaving spouse makes less income than the other), and that not be considered abandonment?

Abandonment can be considered an act of marital fault when one spouse brings cohabitation to and end without just cause, and without the consent of the other party.

I’m in the military and the wife has told me she will not move to where I’m stationed and remains in North Carolina. Could this be consider abandonment?

It could be, depending on the circumstances, without a full understanding of the case I cannot say for sure how her refusal to move would impact the case.
