Is there a statute of limitations on filing an alienation of affection suit? My husband’s ex-wife is threatening a possible suit because we are trying to get her alimony payments suspended…the “alleged” alienation was in 1975. We have been married over 30 years now, and he has never missed a payment.
The statute of limitations for filing suit for alienation of affection is 3 years from the occurrence of the alienating behavior.
Can the person bringing the suit ask for attorney fees? Can the person being sued, file a counterclaim asking for attorney fees?
Both sides can seek attorney’s fees.
