I have been unemployed for the last 2 1/2 years while being married for several reasons, none of which my wife objected to. Her best friend passed away 1 month ago today, but shortly after her passing she advised me she wanted a divorce. I drew up papers based using an alimony calculator, which I know NC does not have, but other states do.
Am I eligible to collect alimony payments? I am not sure if their is an affair going on or not, but she has also stayed the last 3 nights at his house because she will not stay here if I am there. I know there may be other options or avenues to go with this as well, but alimony is what I am looking at right now.

Whether you are eligible for alimony first depends on whether you are a dependent spouse. After that determination is made, the court looks at 16 factors as well as your needs and your spouse’s ability to pay, to determine the amount and duration of alimony.
