Back Taxes

I’m in the midst of negotiating terms with my STBX, and one of the items of concern is back taxes. They were incurred during the marriage. Is he liable for 50% of the payment of these? The tax bills from the IRS and the state are addressed to both of us even though the debt was due to my failure to file taxes on time.
