I have a 7 week old baby. The Father and I are not married. At the time of delivery I did not put his name on the birth certificate. What rights does he have ? Someone told me if he wasnt on the birth certificate and being that he and I are not married he has no rights.
Without a court order defining custody, he has just as much right to custody of the child as you do. He will likely have to file an affidavit of parentage and/or submit to genetic marker testing to establish paternity legally, but if you deny him access to the child or visitation, there is nothing stopping him from filing an action for custody immediately. There just may be additional steps that he is required by the court to take along the way.
