Can spouse residing in home pack my belongings?

My spouse has a protective order filed against me. Can they pack up my things without my permission. My name is on the deed.

Hello Chewtoy,

Yes, they can pack up your belongings & put them aside (boxes, bags etc).

This would be a good time to file for Interim Distribution to get your things, also file for ED & other entitlements you may have.

Best of luck.

There are no provisions in the equitable division statutes that dictate how or when personal items will be packed. If the protective order is in effect for a year, and you are not allowed to go to the residence to get your belongings, you should try to arrange getting them from her through a 3rd party, or file an equitable distribution lawsuit and ask the court for assistance.
