Change of circumstance

If a child is diagnosed with ADHD after a order for custody is issued could that be considered a change of circumstance.

I have my child %40 of the time. Because of this we exchange our child mid week during school. I would like to argue that with this new circumstance, it would be better if the parent who starts the week finishes it since we are now applying different plans and methods to help with school. Most of the testing at school is on Friday. These tests are the only real measured feedback we have to determine if what we are doing is working and what changes we may need to do. The midweek exchange makes things a little muddy since the week started with one parent and is finished by another.

I believe the child’s diagnosis can be a basis for modification, especially given the facts you list, and the possible mal-effect the current schedule may be causing.
