We was never married we lived together for maybe 3 months he left before my baby was born she was born in 2016 in Georgia. I asked him for financial help many times n also gave him the option to get her stuff such as milk clothes n etc. But never got help from him. Now that i moved to North carolina but will keep my job in georgia and i have 2 places in georgia things will be a little tight since i am still making payments for both places in georgia one of the house is not livable due to that i cannot rent it out. The second place is good to rent out but since i dont have the money nor a way to bring my stuff here yet so i have to stay there the days i will be working in GA because i only work 4 days.
Now with all this being said.
I want to file childsupport and want to know if i can get him to pay from since the day she was born? since she has lived with me and has stay with me 365days out of the year because he has not want to spend time with her. And how will it work on since i am now a resident of north carolina and he lives in georgia?
You cannot receive child support dating back to the time your child was born, but you may be able to have child support awarded for the last 3 years plus prospective/future support awarded.
You would file for child support in North Carolina since that is where you and your child live. NC will have personal jurisdiction over the father if you can meet one of the statutory requirements as set forth in N.C.G.S. 52C-2-201: Bases for jurisdiction over nonresident.
