You can agree to anything you want as far as dividing the debt goes. If you were to go to court a judge would divide the totaldebt, usually equally.

I am in the process of filing for a separation. My husband and I don’t have any “Joint” credit cards. Would the total debt that we have still be split if that is what is agreed upon or would we each be responsible for our own credit card debt?
