I would like to know what kind of SPECIFC evidence is needed to prove that your spouse had sex prior to separation (criminal conversation)?

Would you need email records, pictures, video, an eyewitness???

And what kind of punitive damages can be sought from the 3rd party?

Evidence such as emails, pictures and eyewitness accounts are all admissible in court to prove that sexual intercourse occurred. A suit for CC involves a Plaintiff seeking money damages, normally in excess of $10,000.00.
