If you want to divorce you must live apart (not in the same house…it doesnt matter if it is the crawlspace)You must have 2 different residences, there is NO way around it.
What would you do if you could get a divorce tomorrow? Would you 2 still live together? You can act as if you arent married at all: split the assets, debt, draw up seperation terms/papers, move on with your own lives…etc. You can not remarry or have sexual relations with someone else legally. If you want to seperate why would you want to share bank accounts, or live under the same roof? Maye you and/or her should move in with relatives until you become financially stable enough to live on your own.
Greetings. Correct - living in separate areas of a house or even of the same property does not qualify as living separately to start the one year count down to divorce. You may want to speak with someone at social services about other options. Thank you.

The wife and me I have been emotionally divorced for nearly 2 years.We now want to separate. The problem is housing is to expensive and I am on medicare disability.
So I live in a seperate part of the house.If I understand NC laws this does not qualify as legal separation.We were going to a lawayer and have searation papers drqwn up but that seems useless now.
Another problem is my wife is my legal caretaker.
What a mess!!!
Is there any solution other than my moving out???
And must we have separate bank accounts???/
