If there is a medical practice involved where one spouse is a full partner of an S-Corporation, how is it valued and/or distrubuted in the event of a divorce? Is the partner’s spouse entitled to a portion of the buy-in amount or of the current valuation of the practice?
The business should be valued by a qualified business appraiser. Half of the value of the participating spouse’s interest in the S-corp which was acquired during the marriage is divisible.
