Where can I obtain the forms necessary to file for emergency custody? I have primary physical and sole legal custody of 3 minor children and my former spouse took them last Monday without my permission and refuses to return them. I already have a show cause hearing for 3/15, but I am concerned for their wellbeing. She refuses to bring them to school which is our exchange location.
There are no pre-printed forms or templates for emergency custody. Since you already have a custody action pending, you will need to file a motion for emergency ex parte custody and submit a proposed order at the time you file the motion. The clerk’s office can give you direction on how to make sure the motion and proposed order get to the judge quickly.
