August 2, 2018, I was kicked out of my home because my wife filed a FALSE Domestic Violence Protective Order against me. I was not guilty of what she was saying about me. The lawyer that represented me did not do a good job to me because he never talked to me about what happened in the home. After two courts continuance, I had to write him a letter to tell him my side of the story. The case was dismissed October 15, 2018, by my wife’s lawyer after they could not get me to pay something about the separation of property and the letter I wrote to my lawyer about what really went on in the home. in the home and I guess he told my wife’s lawyer because my wife knew about the letter too. What do I need to do to get back in my home? My wife was the person in the home trying to fight me, threatening me, calling my job trying to get me fired, and right now I have 12 harassing message on my 85-year-old mother’s phone and my cell phone all from 10/23/2018 because I went to the home to pick up somethings and forgot my son had the key to my lock retreat room.i NEED YOUR HELP!
Without a court order requiring you to stay away from the house, then you should be able to go at any time to get things that you need. However, you should inform your wife that you will be going and try to coordinate a time that she won’t be there so you can pack your things.
Otherwise, you will have to file a claim for equitable distribution and a motion for interim distribution, along with any other claims you may have, asking for the house to be distributed to you ahead of time or at least to allow you back in to get specific personal property items.
