Greetings. No, it does not sound like he will be able to obtain these funds from you. There is a presumption that it is a gift, and he would have to refute that and that would probably take more evidence then he has. Thank you.

Am I to pay back money that was pre-marital???

Money was brought into the marriage, a home was purchased, then sold and another home was bought.

Now DH is saying it was not a pre-marital gift. No pre-nup was signed. Am I to pay back with proceeds gained from sale of house???

Please help with this one??? If you need more info, please ask, will give what I know.[xx(]
