Going to Another State for an Affair

Dear archie:

Greetings. It is adultery and constructive abandonment. Abandonment means leaving the martial residence to live some where else. Best of luck and let us know if we can help.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. If I file for divorce fro bed & board, while she’s away to see her boyfriend, am I allowed to change the locks on the house & not allow her back?

Dear Archie:

Greetings. The answer is no. Filing for divorce from bed and board is an action requesting that the court remove one of you from the marital residence, not a license to kick someone out. Best of luck.

If my wife were to travel to another part of the country, for the sole reason to continue an affair, would that be abandonment?
