Husband Walked Out On Us

Hi, my husband walked out on us (me and 3 children) the last time I spoke to him I told him he could come visit his daughter. He’s recently been making threats about taking our daughter. What are my rights?

You will need to file a child custody lawsuit against your husband in order to obtain a court order that lays out a custody and visitation schedule for your children.

If there is a substantial risk that your husband would remove your daughter from the State of NC for the purpose of evading jurisdiction of NC courts, then you can file a motion for ex parte (emergency) custody along with a custody complaint in order to receive an immediate court order.
