Last Judge to enter order

We do not practice in Currituck, NC and cannot tell you of the local customs in that county. However, in courts where where it a family court system generally one judge is assigned for the entire case. I would contact an attorney in your county to see if they can answer your question. Since he says he got this information from the clerk of court you might try contacting them on your own and see that they say.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

Is the last judge to enter a custody order the only one who can hear or modify that order. During this case in Currituck, NC there have been 4 different judges to enter orders but just to take the doubt out of my mind I needed to ask. Because my STBX keeps saying this will be continued because it has been scheduled to be heard by another judge. I haven’t heard from my attorney but his assistant says she has never heard of this. He says its a NEW LAW??
He says that the clerk of court supposedly advised him of this. But why would they even assign another judge if they know she can’t hear it. I am pretty sure he is incorrectbut would like reassurance.

Thanks
