My ex-husband took out an individual loan while we were still married. Also, we have both of our names on my car. We had earlier agreed that i would refinance the car in my name, he told me that the lending company would refinance it at the same rate. I called them this morning and they told me it would jump a couple of percentage points if I did so. They informed me that since both of our names are on the car, he can not force the sale of it and could not sue me as long as the payments are made in a timely manner (which they are). The uncontested divorce is final and a decree has been issued and there was no mention of the car or the loan. He is now threatening to sue me. So, my questions are:
- Can he sue me for any of the individual loan?
- Can he sue me to take his name off of the car?
