Assuming that you have been making payments on the house then you will have a marital property interest the house that will be divided. Good luck.

WE PURCHASED OUR HOME PRIOR TO BEING MARRIED. WE LIVE IN THE STATE OF NORTH CAROLINA. WE LIVED IN THE HOME 2 YEARS PRIOR TO MARRIAGE AND HAVE BEEN MARRIED 10 YEARS AND 8 MONTHS. WE BOTH HAVE CHILDREN FROM PREVIOUS MARRIAGES BUT NONE TOGETHER. WE BOTH WORK AND HAVE CONTRIBUTED EQUALLY TO ALL HOUSEHOLD EXPENSES. WE DID TAKE OUT A HOME EQUITY LOAN SEVERAL YEARS AGO THAT WE ARE STILL PAYING ON. IT WAS IN BOTH OF OUR NAMES AND WE WERE MARRIED AT THE TIME. DO I HAVE ANY RIGHTS TO THE HOUSE IF WE DIVORCE SINCE IT IS TITLED IN HIS NAME ONLY? ALSO, IF MY HUSBAND PASSED AWAY COULD HIS SON MAKE ME MOVE? THANKS
