I have been active duty military for 15 years. Once my divorce is finalized, I will have been married for 8 years. Once I retire, what is the percentage my former spouse will be entitled to receive from my retirment pay? Also, is the former spouse entitled to a percentage of the BAH? How long are these entitlements required to be paid?
The court can divide retirement like they can any marital asset if its necessary to effectuate an equitable distribution. This division will be half of the marital portion, the amount accrued during the marriage. BAH is counted as income for you, so it would affect the amounts of any alimony or child support which you are required to pay. Beyond that, I cannot say what the military requires about BAH, so you will need to speak to someone in your service to determine what your wife’s entitlements to that are.
