There are no particular laws regarding moving out of state with your child, until there is a custody order in place you each have the right to custody of your minor child. If there is no custody order in place you are not kidnapping your son, but unless there is a court order in please, either of you could go to court at anytime and ask the court to determine what custody arrangement is in the best interests of your child.
Your post said you did not have the money for an attorney, however, most people can generally afford to at least consult with an attorney, before myself or any attorney could tell you whether or not to move out of state, they would need to sit down with you and review all the facts of your case.
