NC State Employee Retirement

Good Afternoon. My wife and I are both state employees and divorcing. She has retained a lawyer and drawn up a consent order that settles distribution and support as we agreed. The consent order grants her total TSERS retirement and 40% of mine. Can you tell me how this number is reached?

It is likely based on their equitable distribution balance sheet and how they believe an equal distribution of the marital retirement assets looks. Perhaps you have other retirement in which she does not.

Thank you so much for your reply. My soon to be ex and I figured out the equitable distribution on our own. It was really pretty straightforward with no children or businesses, so there is no Equitable distribution balance sheet. The 6040 may be fair, but I don’t know how to verify that. I’ve asked her how her attorney arrived at that figure. Thanks for any help you may be able to give.
