My mother’s estranged husband died March 21. They were not divorced. However, on the death certificate it was stated that he was divorced with no surviving spouse. That is not correct and is preventing her from getting SS benefits and VA benefits that she is entitled to as a widow. I promise…there is NO divorce decree on file anywhere! THEY were never DIVORCED!!! Are there any penalties in NC for falsifying information on a death certificate? Gotta be! What can WE do about this? Please help! Thank you.
I would assume there are penalties for lying on a death certificate, however I do not practice in that area of the law. I suggest you contact a lawyer who handles wills and estates.
