Post Separation Support -
(not Child Support )

I was told by several men who have been through this, that any money given to the STBX before a signed agreement is in place or Judge’s decision
will Not be counted in the court’s eyes.

Is this true ?
Or does it count if I write checks ?

Also - what is the probability that the judge will award post separation support to be paid from the DOS to now ?

The court will consider voluntary support paid to a dependant spouse, however absent an executed agreement or court order, the support is not deductable from the payor’s income according to the IRS.

I cannot predict what a judge will do in any one case, however if you have been paying support voluntarily, I see no reason why a judge would order any retroactive support.
