Alimony/pss question

We do not yet have a signed agreement, but I gave him a total of $9000 in checks over the 1st 6 months of our separation, and have been paying his health insurance costs, car insurance and health club for 14 months now.

He says that none of this counts as alimony since we don’t have an agreement in place, but I say that a judge would look at the amount of support I have been providing to date and factor that into any alimony awarded.

Who is right?

The support you have paid will be considered as post-separation support, however it is not deductible from your income as the IRS requires alimony to be pursuant to an Agreement or Order to be deductible.
