Premarital Property

Dear IMSTUCK:

Greetings. It sounds to me like these funds are still separate, since you did not say that you added anything to them, just her name to the account. Passive losses and gains (like market ups and downs) on separate property remain separate. Best of luck.

I have question about what’s premarital and what’s not. I have a mutual fund started prior to marriage. I added my wife’s name as joint tenants after we married. The acct was worth $X before marriage and went down by almost half 2 yrs ago. Now it is back up to $X. Is she entitled to any of the funds? Couldn’t she argue the loss and gains occured during the marriage?
