Protect my real estate interests while separating

My spouse and I Own three properties. I would like to have a separation agreement. I’m fairly confident my spouse will not sign an agreement. Is there a way for me to petition the court to separate the properties in our best interest prior to the divorce?

If you and your spouse cannot agree to a property settlement, then you will need to file a court claim for equitable distribution against your spouse so the court can equitably divide all of the marital property.
