Pss

The bank statements can be used as evidence of her ability to pay support and her reasonable expenses. I am assuming that you meet the other requirements for PSS.

the bank statements and my financial affidavit is all I have right now. i m working towards the tax returns.

my wife has filed Ch.13. in the filing she has included the house, the car.

she has a business & its thriving. shes a hair salon owner, which basically is a cash business. mind u, we all hide money.

I served her PSS papers. I got an email from her lawyer saying that im not getting a cent since my wife has nothing.

I have her bank statements that show careless spending. or shall I say spending that is not part of her need. I.e. going out to a club and spending 155.00 on drinks 3 nights a week.

my question is do I have a good PSS case based on the bank statements alone. will the judge even consider those? do I need more documents? or is the judge bsically gonna follow the statute?

p.s. I am pro se does that really matter?
