Greetings. My suggestion is that you retain an attorney. You can look up the number for legal aid in NC, as I do not have access to that or you can call our firm and someone there may be able to provide that to you. Good luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.
My spouse has filed a restraining order against me in the State of North Carolina. I am no longer living in this state, I FLED the situation in the month of August. He states in this order that I have been calling him and harrassing him and that I stole his car. I do have the car, but have not spoken to him since I left. One of the stipulations in the restraining order is that he is asking for posession of this car back. He is doing this in retaliation against me because I filed a restraining order against him in the state I just moved to because he was harrasing me and even went as far as sending 3 different tow trucks to try to get the car back. We are currently separated and as far as I was aware I have just as much right to the vehicle as he does (he currently has another vehicle)until the courts decide how are assetts are to be divided. My main concern is I know I have to answer this restaining order, but I just had a child two weeks ago and I am not in a position to travel. I also have no money since my husband has maxed out all my credit cards. Is there a number for Legal Aid in this state or anyone that can help me with this. All the statements he made against me in the restraining order are not true.
