Separation agreement change in circumstance

My ex and I have a signed separation agreement from two years ago. Is my youngest becoming school age this year enough of a change in circumstance to modify custody? Also if we modify custody can child support them be modified?

If your custody terms are in a separation agreement, you do not need to meet the substantial change in circumstances standard to amend the terms. Generally, a separation agreement can be amended as long as both parties agree to the amendment. This means child support can also be amended assuming the child support terms are also in the separation agreement.

Be sure to check your separation agreement for any amendment clauses and/or custody and child support modification clauses. Oftentimes separation agreements will require the parties to attend mediation to resolve any disagreements on these issues prior to resorting to court.
