If we have no property or assets to divide and all issues pertaining to the kids have been resolved between us do we have to have a seperation agreement to get a divorce?
If you have no assets or property then a separation agreement may not be necessary, and, regardless of any agreement between the two of you, please be aware that either of you could go to court at any time for custody or child support.
