This is addressed several times in different areas but I want to be sure I am clear on this topic. My husband and I are seperating. Are we required by law to have a seperation agreement or after living apart for a year can we not simply file for divorce?
You are not required to have a separation agreement, and do not need one if all property issues have been resolved prior to divorce.
