Separation Question

If, there is no legal seperation agreement and there are emotional or sexual affairs that can be proven, then in NC it is considered Misdemeaner Adultry but, the courts will only consider it for whether alimony is paid and in most cases, the Adultry must have occurred before you seperated. Not legal seperation but, just stopped living together with the intent to seperate/divorce.

If a person is separated (for two years) and has a child from the relationship, but has not filed for a legal separation, are they allowed to date other people? What kind of problems, if any, can this cause when they go to file for separation/divorce?
