Sexual Abandonment

Can this be grounds for a divorce? Three years, no sex. No cheating, no disfunctions of any sort, just sex was for producing two children. Husband wants to leave, but afraid to lose kids. Wife doesn’t work. Does he have a leg to stand on?

North Carolina is a no fault divorce state, the actual divorce is based on a one year period of separation. As for property distribution non economic fault is not considered.
When two parents split up it is rare for a parent to “lose” the children. So long as both parents are a fit and proper persons to care for the children there is no reason that both parents will not have time with the children.
